About this policy

Prospero Fund Pty Ltd (ABN 20 682 670 702, ACN 682 670 702), trading as Prospero Fund (we, us or our), respects your privacy. This policy explains how we collect, hold, use and share personal information when you visit our website, contact us, respond to our advertisements or use our mortgage and finance broking services.

We are committed to handling personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Mark Jayson Rafols Yu is an Authorised Credit Representative (CRN 565028) of Australian Finance Group Ltd (AFG), ACN 066 385 822, Australian Credit Licence 389087. AFG handles information under its own Privacy Policy.

Information we collect

The information we collect depends on how you interact with us. It can include:

We only seek sensitive information where it is reasonably necessary for our services and we have your consent, or collection is otherwise permitted or required by law.

How we collect information

We collect information directly from you through our website forms, Facebook and Instagram lead forms, Messenger conversations, email, text messages, phone calls, meetings and documents you provide.

When relevant to your finance enquiry and with any required authority, we may also collect information from your authorised representatives, AFG, lenders, referral partners, accountants, employers or other parties assisting with your application. Any credit-report access requires the appropriate authority and lawful basis; submitting a website or Meta enquiry alone does not authorise a credit check.

You can make a general enquiry without identifying yourself, where practical. If you do not provide information needed to assess your circumstances or verify your identity, we may be unable to provide credit assistance or progress an application.

Why we use and share information

We use personal information to:

We may share relevant information with AFG, prospective or existing lenders, and parties involved in arranging your finance, such as valuers, mortgage insurers, solicitors, conveyancers and your authorised representatives, where necessary and permitted by law. We also use service providers for customer record management, communications, website hosting, analytics and business support. These include BrokerEngine, email and messaging providers, GoDaddy and Google.

We may disclose information to regulators, courts or other authorities where required or authorised by law. We limit disclosures to information relevant to the purpose.

Facebook, Instagram and Messenger enquiries

When you submit a Meta lead form or contact us through Facebook, Instagram or Messenger, we receive the information you submit and the profile or contact information the platform makes available to us. We use this information to respond, arrange a consultation and follow up your enquiry through the contact details you provide.

We do not sell information collected through Meta lead forms or Messenger enquiries. We share it only as needed to handle your enquiry, provide requested services or meet legal obligations, consistently with this policy and applicable Meta terms.

Meta also handles information under its own Privacy Policy. Please avoid sending identity documents, bank statements or other detailed financial records through social media messages. Ask us for the appropriate document submission method.

Marketing choices

If we send you promotional communications, we do so with your consent or as otherwise permitted by law. You can opt out at any time by using an unsubscribe option where provided, replying to ask us to stop, or contacting hello@prosperofund.com.au. Opting out of marketing does not prevent communications needed to handle an active enquiry, application or legal obligation.

Website cookies and Google Analytics

Our website is hosted with GoDaddy and uses Google Analytics to help us understand website traffic and improve the website. Cookies and similar technologies can collect information about visits, interactions, devices, browsers and approximate location. Google receives information through the analytics service; its handling of that information depends on the service configuration and Google's policies.

Read how Google uses information from sites and apps that use its services and Google's Privacy Policy.

You can manage or delete cookies through your browser settings. Blocking cookies may affect some website features. Google also offers a Google Analytics opt-out browser add-on for supported browsers.

Our website does not currently use Meta Pixel. If our tracking practices change, we will update this policy and provide any notices or choices required by law.

Storage, security and retention

We hold information in email, Facebook Messenger, text message records and BrokerEngine, together with documents and records used to provide our services.

We take reasonable steps to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure. Access is limited to people who need the information for their work. No online service or transmission method can guarantee complete security.

We retain information for as long as reasonably needed for the purposes described in this policy, including applicable legal, credit-assistance, compliance and record-keeping requirements. When information is no longer needed and retention is not required by law, we take reasonable steps to destroy it or de-identify it. You can ask us about deletion, but we may need to retain records for these reasons.

Overseas access and service providers

Authorised staff or contractors in the Philippines can access customer information to support our operations and services.

Our technology providers, and providers used by AFG or lenders, may also process or store information outside Australia. Locations depend on the provider and service. For example, AFG's published privacy policy identifies support providers in the United States, Canada, Malaysia, India, Ireland, the United Kingdom and the Philippines. These are AFG's disclosed locations and do not mean that Prospero Fund has staff in each country.

We take reasonable steps required by applicable privacy law when sharing information with overseas recipients. Contact us for further information about overseas handling relevant to your enquiry or application.

Access and correction

You can request access to personal information we hold about you, or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details below and describe your request. We may need to verify your identity before responding.

We respond within a reasonable period. If the law permits us to refuse access or correction, we will explain the reason and the available complaint options, except where we are not permitted to do so.

Privacy questions and complaints

Please contact Mark Yu, Privacy Contact, if you have a question, request or complaint:

For a complaint, please describe what happened and the outcome you are seeking. We will acknowledge your complaint, investigate it and aim to respond within 30 days. If more time is needed, we will explain why and keep you informed.

If your concern relates to AFG's handling of information, you can also contact complaints@afgonline.com.au. AFG's Privacy Policy explains its process.

If your complaint remains unresolved, you can contact the Office of the Australian Information Commissioner on 1300 363 992. Other external complaint options may be available depending on the matter, including the Australian Financial Complaints Authority for eligible financial services complaints.
